About this privacy policy
Video Colorado is a trade name of Panamericana Media LLC, a Colorado limited liability company. For purposes of this Privacy Policy, “Video Colorado,” “Panamericana Media,” “we,” “us,” and “our” refer to Panamericana Media LLC, including when it operates under the Video Colorado trade name.
Panamericana Media LLC operates videocolorado.com (the “Site”) and is responsible for the personal information described in this Privacy Policy.
We collect and use information for legitimate business purposes, including responding to inquiries, developing and delivering creative work, communicating with clients and collaborators, managing projects and files, processing transactions, operating and improving our website and services, maintaining business records, and protecting our systems.
We seek to collect only information reasonably necessary for those purposes. We do not sell personal information for monetary compensation, and we do not collect personal information simply because it might be useful later.
This Privacy Policy explains how we collect, use, disclose, store, and otherwise process personal information when you visit or interact with videocolorado.com; contact us or request information about our services; become or are associated with a client, prospective client, vendor, contractor, collaborator, talent participant, or other business relationship; participate in or work with us on a production or project; or otherwise interact with Video Colorado where this Privacy Policy is provided or referenced.
This Privacy Policy applies to information processed by Panamericana Media LLC in connection with Video Colorado. Other Panamericana Media services, websites, campaigns, or activities may be subject to additional or separate privacy notices where appropriate.
Information we collect
The information we collect depends on how you interact with Video Colorado and the nature of our relationship with you.
Information you provide directly. When you contact us, submit a project inquiry, request a proposal, participate in a project, or otherwise communicate with us, we may collect information such as your name, email address, telephone number, organization or company, job title or role, preferred method of communication, project type, project description, anticipated timeline, budget or investment range, production-related location information, and any other information you choose to provide.
Project and production information. When we work together, we may receive, collect, or create information necessary to develop and deliver the project. This may include creative briefs, scripts, treatments, schedules, call sheets, budgets, estimates, client contacts, interview information, participant or talent information, releases and permissions, feedback and approvals, brand assets, photographs, audio and video recordings, raw and edited footage, graphics, reference materials, project files, and delivery specifications. Because our work often involves real people, some production materials may include names, images, voices, likenesses, personal experiences, or other information relating to identifiable individuals.
The collection, use, ownership, licensing, confidentiality, retention, and permitted use of certain project materials may also be governed by the applicable production agreement, statement of work, release, license, nondisclosure agreement, or other contractual arrangement. This Privacy Policy does not replace those agreements.
Business and transaction information. If you become a client, vendor, contractor, collaborator, or other business partner, we may process information contained in proposals, statements of work, contracts, invoices, payment records, transaction confirmations, tax or accounting records, vendor documentation, and other records reasonably necessary to administer the business relationship. When payments are processed through a third-party payment provider or financial institution, payment information may be provided directly to that provider, and we generally do not need to store complete payment-card information ourselves.
Communications and technical information. We may retain emails, contact-form submissions, meeting information, project-management communications, feedback, support requests, and other correspondence. When you use videocolorado.com, we or our service providers may also receive technical information such as your IP address, browser and device type, operating system, referring source, pages viewed, approximate location derived from your IP address, dates and times of visits, and general website interactions, depending on the technologies enabled on the Site.
We seek to collect only personal information that is reasonably necessary for our business, our services, the relevant project, or another purpose described in this Privacy Policy.
How we use information
We use personal information primarily to operate Video Colorado and deliver our services. This includes responding to inquiries, communicating with prospective and existing clients, evaluating potential projects, developing creative approaches, preparing proposals and estimates, scheduling and managing productions, coordinating interviews and filming, administering contracts and releases, collaborating with clients and production partners, producing and editing creative work, managing review and approval processes, delivering final materials, processing invoices and payments, and providing project or client support.
We may also use information to operate Panamericana Media LLC and maintain appropriate business records, including accounting, tax, insurance, legal, administrative, vendor, and contractual records. Information may also be used to maintain and improve our website and services, understand how visitors find and interact with videocolorado.com, protect our accounts, systems, files, and business from fraud, misuse, unauthorized access, or other security threats, and establish, exercise, or defend legal rights.
We may use contact information to follow up on an inquiry or communicate with you in connection with an existing or previous business relationship. Where permitted by applicable law, we may also send relevant business or marketing communications. Where consent or an opt-out mechanism is required, we will provide the appropriate choice.
We may use information for another purpose when that purpose is disclosed to you at the time of collection, when you direct or authorize us to do so, or when otherwise permitted or required by applicable law.
Our reasons for processing
Depending on the circumstances and the laws that apply, we process personal information on one or more lawful grounds. We may process information because it is necessary to respond to your request or take steps before entering into a contract, because it is necessary to perform or administer a contract, or because processing supports legitimate business interests such as operating our business, communicating with clients and collaborators, delivering our services, maintaining appropriate records, improving our operations, and protecting our systems and information.
We may also process information when necessary to comply with a legal obligation, establish, exercise, or defend legal rights, or when you have provided consent. Other lawful grounds may apply depending on the jurisdiction and circumstances.
Where we rely on consent, you may withdraw that consent where applicable. Withdrawal of consent does not affect the lawfulness of processing that occurred before consent was withdrawn or processing that is permitted on another lawful basis.
Nothing in this section is intended to create rights or obligations beyond those provided by applicable law.
How We Share Information and Who Receives It
We do not disclose personal information indiscriminately. We may share information when reasonably necessary to operate our business, respond to a request, deliver a project or service, administer a business relationship, protect our rights or systems, or comply with applicable law.
We may share information with service providers that support our website and business operations. Depending on the services and project involved, these providers may assist with website hosting and forms, customer relationship management, email and communications, project management, cloud storage and file transfer, video hosting and review, digital asset management, scheduling, accounting and bookkeeping, invoicing and payment processing, analytics, search performance, cybersecurity, electronic signatures, document management, data backup, and other operational or professional services.
Our technology environment currently includes or may include services provided by Zoho, Framer, and Google, as well as other providers selected for specific production or business functions. The particular providers we use may change as our business and technology needs evolve. Service providers receive information appropriate to the functions they perform and handle information subject to applicable contractual, privacy, security, and legal obligations.
Because film production frequently requires specialized expertise, we may also share information or project materials with employees, independent contractors, freelancers, production companies, creative collaborators, and specialized vendors when reasonably necessary for a project. Depending on the production, these parties may include producers, directors, cinematographers, photographers, editors, sound professionals, designers, animators, translators, interpreters, production assistants, talent professionals, rental vendors, or other production partners. We seek to limit their access to information reasonably necessary for their role and the applicable project.
We may disclose information to professional advisers such as attorneys, accountants, insurers, financial professionals, and consultants when reasonably necessary. We may also disclose information when we believe in good faith that disclosure is necessary to comply with applicable law, regulation, legal process, subpoena, court order, or governmental request; enforce an agreement; investigate fraud, misuse, or a security incident; or protect the rights, property, or safety of Panamericana Media LLC, our clients, collaborators, users, or others.
If Panamericana Media LLC is involved in a merger, acquisition, financing, restructuring, sale of assets, change of control, bankruptcy, or similar transaction, information may also be disclosed or transferred as reasonably necessary in connection with that transaction and subject to applicable law.
Cookies, analytics, advertising technologies and third-party content
Video Colorado may use cookies and similar technologies to operate the Site, maintain security, remember certain preferences, understand website performance, and learn how visitors find and interact with our content. Some of these technologies may be necessary for the Site to function properly, while others may be used for analytics or other purposes where enabled.
We may use analytics services, such as Google Analytics, to better understand general website activity, including how visitors reach the Site, which pages they visit, how they interact with those pages, and general information about browsers, devices, and approximate geographic location. Information collected through analytics technologies may be processed by the applicable service provider in accordance with its own privacy practices.
The Site may also contain embedded content or integrations from third-party services, including video platforms such as YouTube or Vimeo and links or integrations involving social media platforms. These third parties may use cookies, pixels, or similar technologies and may collect information when you load or interact with their content. Their processing is governed by their own privacy policies and settings.
We may in the future use advertising, conversion-measurement, or audience technologies such as the Meta Pixel, LinkedIn Insight Tag, Google advertising technologies, or similar services. If these technologies are enabled, they may collect or receive information about interactions with the Site for purposes such as measuring campaign performance, understanding audiences, or delivering and measuring advertising.
Some privacy laws may characterize certain uses of advertising or analytics technologies as “targeted advertising,” “sharing,” or a “sale” of personal information even when personal information is not sold for monetary compensation. If our use of these technologies becomes subject to applicable opt-out, consent, or disclosure requirements, we will provide the notices and choices required by applicable law.
Where required, we may use a cookie or consent-management mechanism to allow visitors to make choices regarding non-essential technologies. You may also be able to limit or block cookies through your browser or device settings. Disabling certain technologies may affect some Site functionality.
Where applicable law requires us to recognize a legally valid universal opt-out mechanism or browser-based privacy preference signal, we will process that signal as required by applicable law.
Project files and confidentiality
Our work may require us to receive, create, store, review, transfer, and otherwise process materials that are not intended for public release. These materials may include raw and edited footage, photographs, audio recordings, interviews, transcripts, scripts, treatments, internal documents, campaign information, brand assets, creative concepts, drafts, rough cuts, credentials, contact information, and other confidential, proprietary, or unreleased materials.
We treat client and production materials as working project assets, not automatically as public content. Access may be provided to employees, independent contractors, freelancers, production collaborators, professional advisers, technology providers, and other service providers when reasonably necessary to perform the project, operate the relevant systems, or fulfill our contractual obligations. We seek to limit access to what is reasonably necessary for the person’s or provider’s role and subject to applicable contractual and confidentiality obligations.
Because our work frequently involves real people, project materials may contain names, images, voices, likenesses, personal experiences, opinions, or other information relating to identifiable individuals. The collection and use of these materials may also be governed by production agreements, participant or talent releases, licenses, client instructions, confidentiality agreements, or other project-specific arrangements.
The fact that we create or possess project materials does not automatically mean those materials may be made public. Any use of client work, footage, photographs, testimonials, client names, logos, or other project materials in our portfolio, website, social media, presentations, case studies, award submissions, promotional materials, or other public-facing communications is subject to the applicable agreements, permissions, releases, licenses, confidentiality commitments, embargoes, intellectual-property rights, and other restrictions.
This Privacy Policy does not itself grant Panamericana Media LLC or Video Colorado any ownership, publicity, licensing, or promotional rights in client or participant materials. Those rights are determined separately by the applicable agreement, release, license, authorization, and law.
Data Retention
We retain personal information and project-related information for as long as reasonably necessary for the purposes for which it was collected or created, including to provide our services, maintain an active or prospective business relationship, support completed projects, maintain appropriate business and accounting records, comply with legal or contractual obligations, resolve disputes, enforce agreements, protect our rights, maintain security, and preserve information where continued retention is otherwise reasonably necessary.
Retention periods vary depending on the nature of the information and the circumstances in which it was collected. For example, a general inquiry may not need to be retained for the same period as a contract, invoice, tax record, release, or other business record. Similarly, working production files may have different retention needs from final deliverables or archived project materials.
Project files, raw footage, photographs, audio, edits, graphics, and other production assets may be retained after project completion for purposes such as project continuity, revisions, re-delivery, backup, archival reference, or other legitimate production and business needs, subject to the applicable client agreement and any agreed retention, deletion, confidentiality, or storage requirements.
When information is no longer reasonably necessary, we may delete, anonymize, de-identify, or securely archive it, as appropriate. Backup copies or information maintained for legal, accounting, security, fraud-prevention, or dispute-resolution purposes may remain for an additional period where reasonably necessary or required by law.
Data Security
We use reasonable administrative, organizational, and technical safeguards designed to protect personal information and project materials against unauthorized access, use, disclosure, alteration, loss, or destruction. These measures may include access controls, account and authentication protections, permissions within business systems, reputable cloud and technology providers, backup practices, and internal procedures appropriate to the nature of the information and the services we provide.
We also seek to limit access to personal information and project materials to people and providers who reasonably need that access to perform their responsibilities.
However, no method of electronic transmission, cloud storage, physical storage, website operation, or information-security system can guarantee absolute security. Accordingly, while we take reasonable steps to protect information in our possession or control, we cannot guarantee that unauthorized access, disclosure, loss, or other security incidents will never occur.
If we become aware of a security incident involving personal information, we will evaluate and respond to the incident and provide notifications where required by applicable law.
International and Interstate Processing
Panamericana Media LLC is based in Colorado, United States. However, the technology providers, professional advisers, contractors, production collaborators, clients, or other parties involved in our operations may be located in other U.S. states or countries. As a result, personal information and project materials may be stored, accessed, transferred, or otherwise processed outside Colorado or outside the jurisdiction in which they were originally collected.
Privacy and data-protection laws vary between jurisdictions. Where applicable law requires specific safeguards for the transfer of personal information across national borders, we rely on appropriate contractual protections, recognized transfer mechanisms, consent where appropriate, or another lawful basis available under applicable law.
By itself, this Privacy Policy does not override any additional data-transfer requirements that may apply to a particular client, project, jurisdiction, or contractual relationship.
Your Privacy Rights and Choices
Depending on where you reside, the capacity in which you interact with us, the nature of the information involved, and the privacy laws applicable to our processing, you may have certain rights concerning your personal information. These may include rights to request access to personal information, correct inaccurate information, request deletion, obtain a portable copy of certain information, restrict or object to certain processing, withdraw consent where processing is based on consent, or opt out of certain uses such as targeted advertising, sale of personal information, or qualifying profiling.
These rights are not identical in every jurisdiction and may be subject to exceptions, limitations, verification requirements, or thresholds under applicable law. Certain information may also need to be retained despite a deletion request where retention is permitted or required for contractual, accounting, tax, legal, security, fraud-prevention, dispute-resolution, or other lawful purposes.
To exercise an applicable privacy right, you may contact us using the information provided in the Contact Us section below. We may request information reasonably necessary to verify your identity, residency, authority to act on behalf of another individual, or the applicability of the requested right before completing a request.
Where applicable law provides a right to appeal our response to a privacy request, you may submit an appeal using the same contact information and clearly identify the request as an appeal.
Children and minors
Video Colorado is directed primarily to organizations and adults seeking professional film production and visual storytelling services and is not designed or intended for children under 18 to independently submit personal information through the Site. We do not knowingly solicit personal information directly from children under 18 through our general website forms.
Our professional productions may, however, involve children or minors as participants, subjects, talent, students, family members, community members, or other individuals appearing in a project. In those circumstances, the collection and use of names, images, voices, likenesses, interviews, recordings, or other information relating to minors may be governed by applicable law, client responsibilities, parental or guardian permissions, releases, production agreements, institutional requirements, or other project-specific arrangements.
This Privacy Policy does not replace any consent, release, authorization, or other permission required for a particular production involving a minor.
If you believe a child has submitted personal information directly through our Site without appropriate authorization, please contact us so we can review the circumstances and take appropriate action.
Changes to This privacy policy
We may update this Privacy Policy from time to time to reflect changes in our website, services, business operations, technology providers, data practices, or applicable legal requirements.
When we make changes, we will update the Last Updated date displayed at the bottom of this Policy. If a change materially affects how we collect, use, disclose, sell, share, or otherwise process personal information, we may provide additional notice or obtain consent where required by applicable law.
We encourage you to review this Privacy Policy periodically if you continue to interact with us.
